Terms and Conditions
AGREEMENT OVERVIEW: This Agreement expresses the full and complete agreement between the CLIENTS (Business Name, stated above) and Fred Photography and Digital (Hereafter referred to as FRED PHND) regarding the subject matter hereof. It supersedes all prior agreements. The only way to add or change this agreement is to do so in writing, signed by all parties.

CANCELLATIONS and AMENDMENTS: By agreeing to this quote FRED PHND will confirm your shoot date as set out as above. Amendments may be made to the shoot date outside the following. All timelines exclude weekends and holidays. Cancellation within 48hrs; 50% of shooting costs and all 100% of billable costs. Cancellation within 24hrs; 100% of shooting costs and billable costs. Amendments will be made at the of FRED PHND to help you work around unforeseen circumstances such as weather and third-party suppliers. If reshooting is required, or additional time is required the CLIENT will be liable for the extra charges. 

IMAGES and COPYRIGHTS: Photographs/images/digital media produced by FRED PHND are protected by Copyright Law (all rights reserved). Upon final payment by CLIENTS, CLIENTS are allowed to display resulting images for personal and commercial use. Images may not be altered or reproduced in any manner without prior written permission of FRED PHND. CLIENTS will receive high-resolution digital copies with rights as set out by agreement of both parties. When publishing the photos socially or commercially, FRED PHND must be noted as the photographer. The CLIENTS must obtain written permission from Fred photography and digital to the CLIENTS, their associates, friends or relatives selling the photographs. 

USGAE. The CLIENT will have 24 months of usage rights for the photographs for the agreed purpose. If more than one commercial client is commissioning the assignment or is to provide with some images, my fees will be adjusted to reflect broader use and greater value of the photographs. FRED PHND will retain copyright. Images used outside the licensing terms, or if passed on to a third party without written permission from FRED PHND will incur the full licensing fee of $500.00 per image payable by the client. If an image is used for commercial advertising, use by either the client or a third party without permission from FRED PHND a fee of $100 000.00 and any additional cost incurred will be payable by the client. 

MODEL RELEASE. The CLIENTS hereby grants to FRED PHND and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the CLIENTS or in which the CLIENTS may be included, for editorial, trade, advertising or any other purpose and in any manner or medium; to alter the same without restriction and to copyright the same. The CLIENTS hereby release FRED PHND and all associates representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from or related in any manner to FRED PHND use of said images.

INVOICES. The client is reasonable for the final payment in a timely matter as set out on the invoice. Late payment fees will able. Legal action will be undertaken once payment is 30days late.
